Holiday parks orders

List of orders NCAT can make under the Holiday Parks (Long-term Casual Occupation) Act 2002 (NSW).

If you are applying to NCAT you must quote the section of the Act that you issue falls under. Write the section number in the orders section of the application form. You may also have to provide supporting documents as part of your application.

If you have received a notice of hearing, the section numbers may help you understand why you have been taken to NCAT and learn the types of supporting documents you should gather.

Written agreement

Breach of agreement or disagreement

26 An order in respect of a breach of the occupation agreement Occupant or park owner During the currency of the agreement or within 30 days after the termination of the agreement
26 An order in respect of a disagreement about something other than the occupation fee that could form the basis of a breach of the agreement ( Occupant or park owner During the currency of the agreement or within 30 days after the termination of the agreement

Abandoned site

32 An order that the site has been abandoned Park owner -
33 An order for compensation for loss caused by abandonment of the site Park owner -
