NSW Civil and Administrative Tribunal (NCAT)

Updated procedural direction on expert evidence

Announcement - 2 March 2018

The President has revised NCAT Procedural Direction 3 - Expert Evidence which sets out how expert witnesses are to provide evidence in Tribunal proceedings.

Expert witnesses may provide NCAT with expert evidence about technical matters or areas of specialised knowledge that is relevant to an issue to be determined in proceedings.

In order to differentiate between proceedings where it is appropriate to take a stricter approach to expert evidence (such as proceedings where the Tribunal is bound by the rules of evidence) and those where consideration of proportionality and fairness require a less strict approach the Expert Evidence Procedural Direction has been revised.
