​Changes to Retail Leases Act 1994

Announcement - 30 June 2017

From 1 July 2017, legislative changes to the Retail Leases Act 1994 will affect how retail lease applications are lodged at NCAT.

Major changes include:

  • Jurisdiction for retail leases applications has now increased from $400,000 to $750,000 for leases entered after 1st July 2017.
  • New section 32B under the Retail Leases Act 1994
    • Provides for the appointment of specialist retail valuers by the Registrar of the Office of the NSW Small Business Commissioner. 
  • Appointment of specialist retail valuers
    • All applications about the appointment of specialist retail valuers will be dealt with by the Office of the NSW Small Business Commissioner
    • NCAT will no longer deal with matters about the appointment of specialist retail valuers.
If you are planning on lodging an application for the appointment of a specialist retail valuer, it is suggested that you wait until 1 July 2017 when you can apply directly with the Office of the NSW Small Business Commissioner.
