​Updated set aside or vary Tribunal decision form

Announcement - 28 August 2015

NCAT's 'Application to set aside or vary Tribunal decision' form has been revised and updated, and is now available.

Parties to proceedings may apply to NCAT to set aside or vary a decision that determines proceedings under clause 9 of the Civil and Administrative Tribunal Regulation 2013 as an alternative to an appeal.

The grounds for an application to set aside or vary a decision are limited to the following circumstances:

  1. All parties agree that the decision should be set aside or varied.
  2. A party was not present when the decision was made and as a result the case was not adequately put to the Tribunal.
